2. Eligibility and User Requirements

2.1 Age Requirements

To use our Services and purchase e-vignettes, you must:

• Be at least 18 years of age or the age of legal majority in your jurisdiction
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using our Services under applicable laws
• Be the registered owner of the vehicle or have explicit authorization from the vehicle owner

If you are under 18 years old, you may only use our Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

2.2 Account Registration

When creating an account, you agree to:

3.3 Product Specifications

3.4 Accuracy of Information

4. Ordering and Purchase Process

3. Choose the desired vignette validity period (weekly, monthly, or annual)
4. Select the activation start date (immediate or future-dated)

6. Review your order details carefully before submitting payment
7. Complete payment using an accepted payment method

4.2 Order Acceptance and Confirmation

Your order constitutes an offer to purchase our products. We reserve the right to accept or decline any order at our sole discretion. Order acceptance occurs when:

• Payment is successfully processed and verified
• We send you an order confirmation email
• The vignette is registered in the Bulgarian Road Infrastructure Agency database

You will receive two emails:

1. Payment Confirmation: Immediate confirmation that payment was received
2. Vignette Certificate: Digital vignette certificate (within 5 minutes) containing:

4.3 Order Errors

5. Vignette Activation and Validity

5.1 Activation Process

Upon successful purchase:

• Your vignette is automatically registered in the Bulgarian Road Infrastructure Agency database

• Once activated, the vignette cannot be paused or suspended

5.2 Validity Period

• Weekly Vignettes: Valid for 7 consecutive days from 00:00:01 on the activation date to 23:59:59 on the seventh day
• Monthly Vignettes: Valid for 30 consecutive days from 00:00:01 on the activation date to 23:59:59 on the thirtieth day
• Annual Vignettes: Valid for 365 consecutive days from 00:00:01 on the activation date to 23:59:59 on the 365th day

Validity periods are calculated in full 24-hour days regardless of purchase time. Leap years do not extend annual vignette validity beyond 365 days.

5.3 Verification and Compliance

Bulgarian highway authorities use Automatic Number Plate Recognition (ANPR) cameras to verify vignette validity. You must:

• Ensure your vehicle's license plate is clearly visible and readable
• Maintain valid vignette coverage when using designated toll highways
• Keep your vignette confirmation email as proof of purchase
• Be prepared to show digital confirmation if requested by authorities

5.4 Coverage Area

E-vignettes are required for:

• All Bulgarian motorways (marked with green signs)
• Designated expressways (marked with blue signs)
• Specific highway sections as determined by Bulgarian Road Infrastructure Agency

E-vignettes are NOT required for:

• Local and regional roads (white signs)
• Urban sections of highways within city limits (where clearly marked)

6. Intellectual Property Rights

6.1 Ownership

• Trademarks, service marks, and trade names

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 Cap on Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED EUROS (€100), WHICHEVER IS GREATER.

9.3 Specific Exclusions

• Use of highways before vignette activation
• Fines resulting from expired vignettes
• Technical issues with the Bulgarian Road Infrastructure Agency database
• ANPR camera malfunctions

• Government actions or regulatory changes
• Internet connectivity issues
• Email delivery failures due to spam filters or user error

9.4 Essential Purpose

You acknowledge that these limitations of liability reflect a reasonable allocation of risk and are fundamental elements of the basis of the bargain between you and BG Vignette Pro. We would not be able to provide the Services on an economically reasonable basis without these limitations.

9.5 Jurisdiction-Specific Provisions

Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold harmless BG Vignette Pro, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from:

11. Termination

11.1 Termination by You

You may terminate your account at any time by:

• Using the account deletion feature in your account settings

Account termination does not affect:

• Already purchased vignettes (which remain valid until expiration)
• Outstanding payment obligations
• Rights and obligations that accrued prior to termination

11.2 Termination by Us

We reserve the right to suspend or terminate your account and access to Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Fraudulent or illegal activities
• Providing false information
• Violation of intellectual property rights
• Abusive behavior toward our staff or other users
• Excessive chargebacks or payment disputes
• Suspected security breaches
• Prolonged inactivity
• Technical or operational reasons

11.3 Effects of Termination

Upon termination:

• Your right to access and use the Services immediately ceases
• We may delete your account data and information
• Active vignettes remain valid until their expiration date
• No refunds will be provided for unused account features
• You remain liable for any outstanding obligations
• Sections of these Terms that by their nature should survive termination will survive

11.4 Survival

The following provisions survive termination: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

12.2 Jurisdiction and Venue

Subject to the arbitration provisions below, any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Sofia, Bulgaria. You hereby irrevocably consent to the personal jurisdiction and venue of such courts.

12.3 Dispute Resolution Process

Step 1: Informal Negotiation

Before initiating any formal dispute resolution, you agree to contact us at info@toll-bolgatr.pro to attempt to resolve the dispute informally. We will work in good faith to resolve your concerns within 30 days.

Step 2: Mediation (Optional)

If informal negotiation fails, either party may suggest mediation by a neutral third-party mediator mutually agreed upon. Mediation costs will be shared equally.

Step 3: Arbitration or Litigation

If mediation fails or is declined, disputes may be resolved through:

• Binding arbitration under Bulgarian arbitration rules
• Litigation in the courts of Sofia, Bulgaria

12.4 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You and BG Vignette Pro agree to waive the right to participate in a class action, class arbitration, or other representative proceeding.

12.5 Time Limitation on Claims

Any claim or cause of action arising out of or related to use of the Services or these Terms must be filed within ONE (1) YEAR after the claim or cause of action arose; otherwise, such claim or cause of action is permanently barred.

12.6 European Union Users

If you are a consumer residing in the European Union, you may also have the right to lodge a complaint with your local consumer protection authority or to bring proceedings in your local courts.

13. Modifications to Terms and Services

13.1 Changes to Terms
